CabNorth Driver Terms

Version 2026-07-15-v1. Last updated July 15, 2026. This is a platform agreement outline for operations. Have an Ontario lawyer review before public commercial launch.

1. Not employment

You apply and, if approved, access CabNorth as an independent contractor. Nothing in these terms creates employment, partnership, joint venture, or agency. You control your vehicle, schedule (when online), and expenses. You are responsible for your own income tax, CPP/EI where applicable, GST/HST registration if required, and all costs of operating.

2. Eligibility & checks (mandatory)

I AUTHORIZE CabNorth (and its service providers) to collect, use, and disclose my personal information to verify my identity, driver licence, driving abstract, criminal record / vulnerable sector / police information where permitted by law, vehicle ownership/registration, and insurance, and to repeat or update those checks while I remain on the platform or when CabNorth reasonably requires them. I understand that refusing, delaying, or failing a required check may result in denial or immediate removal from CabNorth. I understand CabNorth is a private platform and granting this authorization does not create employment.

You must hold a valid licence, required municipal/provincial permissions for passenger transportation where applicable, and adequate insurance. You must tell CabNorth immediately if your licence is suspended, charged, expired, or if insurance lapses.

3. Accuracy & documents

I CERTIFY that every statement and document I provide is true, complete, and not misleading. I understand that false, incomplete, or outdated information — including about my licence, insurance, vehicle, health, or eligibility to drive for hire — is grounds for immediate permanent removal and may expose me to civil liability. I have read and agree to the CabNorth Driver Terms (including that I am an independent contractor, not an employee, that I must maintain all legal licences and insurance required to operate, that CabNorth may suspend or terminate access at any time for safety or policy reasons, and that CabNorth is not liable for my lost income). I agree to use in-app masked calling/messaging only and not to misuse rider personal information.

4. Safety & conduct

You must drive safely, follow all traffic laws, not drive under the influence, not harass riders, and not misuse the platform. You must not discriminate unlawfully. CabNorth may suspend or ban you immediately for safety, fraud, rating/quality thresholds, or policy breaches — with or without prior notice when safety requires it.

5. Privacy of rider contact

Rider and driver phone numbers are provided only as needed to complete a trip. Where CabNorth provides masked calling or messaging, you must use those tools. You must not store, sell, spam, threaten, or contact riders outside a live trip for non-trip purposes. Violation may result in permanent ban and referral to authorities where appropriate.

6. Pay, fees, tips

Trip earnings are calculated per CabNorth fare rules (rider-paid fare minus platform fee, plus tips when paid). Payouts are typically weekly. CabNorth is not a bank and does not guarantee payment if a rider charge fails, is charged back, or is fraudulent — disputed amounts may be withheld or reversed.

7. Liability

To the maximum extent permitted by Ontario and Canadian law: you are responsible for your vehicle, passengers while in your care as driver, and third-party claims arising from your driving. The platform is provided “as is.” CabNorth is not liable for lost profits, downtime, matching delays, or indirect damages. Nothing here excludes liability that cannot be excluded by law (including certain injury caused by our own proven negligence where such exclusion is prohibited).

8. Law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable therein. Courts of Ontario have jurisdiction, subject to mandatory consumer protections that cannot be waived.
